§ 1 Scope and Provider

 

 

These general terms and conditions apply to all orders placed by consumers through the B2b Outlet, Polígono Molino del Pilar, Calle George Stephenson, 22 50015 Zaragoza, Spain. Managing director: Oliver Thomas ( “B2B Outlet”). A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

 

 

§ 2 conclusion of contract

 

 

§ 2.1 The product presentations in the online shop do not constitute binding contracts. They serve to submit a purchase offer. A contract is only concluded when Brands Outlet 4u accepts a binding contract offer in accordance with § 2.4.

§ 2.3 Our products are only sold to B2b customers

 

§ 2.4 We accept your order by sending an order confirmation by email or by delivering the goods within five days. The confirmation of receipt of the order does not yet constitute acceptance of the purchase offer.

 

§ 2.5 If our order confirmation contains typing or printing errors or if our pricing has transmission errors, we are entitled to contest in accordance with §§ 119 ff. BGB, whereby we have to prove our error. Payments already made will be refunded immediately.

 

§ 2.6 The contract terms and conditions will be sent by email. Registered users can view their previous orders in our customer login area. Otherwise you will not have access to the data saved by Brands Outlet 4u.

 

 

§ 3 prices and discounts

 

 

§ 3.1 The prices on the product pages include VAT within the European Union and other price components plus shipping costs.

 

§ 3.1 You will be informed about the coupon terms of use. Only one discount voucher can be redeemed per order. Selected brands and products can be excluded. A discount code cannot be redeemed after ordering. A discount code cannot be redeemed after the discount campaign. Discount codes cannot be applied to shipping. Discount coupons are commercially sensitive information that is confidential to recipients. You are not allowed to share discount coupons with anyone or use codes that you did not receive directly from Brands Outlet 4u.

 

 

§ 4 shipping costs

 

 

We ship insured to the specified delivery address immediately after the conclusion of the contract and receipt of payment.

 

Our shipping and delivery times:

 

Insured within the EU for 19.90 EUR (approx. 3-7 working days / no delivery on weekends and public holidays)

 

Insured within the EU with EXPRESS for EUR 119.90 (delivery on the next working day / no delivery on weekends and public holidays / service not available at every destination)

 

International shipping insured (outside the European Union) from 26.90 EUR (approx. 6-10 working days / no deliveries on weekends and public holidays. Please note that additional customs fees and / or (local) processing costs may apply .)

 

International shipping insured with EXPRESS for 199.00 EUR (Guaranteed delivery on the next working day for all orders received from Mon - Fri until 4:00 p.m. (Central European time); no deliveries on weekends and public holidays.)

 

These shipping costs apply per order process. If you order more than one item in a purchase process, there are no additional shipping costs.

 

 

§ 5 delivery conditions

 

 

§ 5.1 Deliveries are made by UPS, DHL or FedEx.

 

§ 5.2 Unless otherwise in the offer deliveries are carried out no later than within 5 business days after conclusion of contract

 

§ 5.3 If not all of the products ordered are in stock, we are entitled to make partial deliveries at our expense.

 

§ 5.4 If the products cannot be delivered successfully even after three attempts, we can withdraw from the contract if we are not responsible for the non-delivery. Payments will be refunded immediately after the items are returned.

 

§ 5.5 If the ordered product is not available because we were not supplied with this product by our suppliers through no fault of ours, we can withdraw from the contract. In this case we will inform you immediately and suggest the delivery of a comparable product. If no comparable product is available or you do not want a comparable product, we will refund your payment immediately.

 

 

§ 6 Terms of Payment

 

 

§ 6.1 Payment can be made either by bank transfer, credit card, debit card, PayPal is not accepted.

 

§ 6.2 If you choose the payment method in advance, we will state our bank details in the order confirmation. The articles will be shipped after receipt of payment. If you pay by credit card, your account will be debited when the items are shipped.

 

§ 6.4 Payment by direct debit is no longer offered.

 

§ 6.5 You are only entitled to offset if your claims have been legally established or are undisputed.

 

§ 6.6 You can only exercise a right of retention if the claims result from the same contractual relationship.

 

§ 6.7 Currency conversion costs are at your expense.

 

 

§ 7 retention of title

 

 

The goods remain our property until full payment. Pledging, assignment by way of security, processing or remodeling without our consent is not permitted prior to the transfer of ownership.

 

 

§ 8 Withdrawal policy

 

 

Right of withdrawal

 

 

 

 

You have the right to revoke this contract within fourteen days, stating your reasons. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods or - if the customer has ordered several separately delivered items as part of an order - on that day on which you or a third party named by you who is not the carrier takes possession of the last item.

Consequences of the withdrawal

 

 

If you withdraw from this contract, we shall have all payments received from you, including shipping costs (with the exception of the additional costs that arise because you have chosen a different shipping method than the most cost-effective standard delivery offered by us) immediately, at the latest within fourteen days the day on which we received the declaration of cancellation. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.

 

We can refuse repayment until the goods have been returned to us or until you have provided evidence that you have dispatched the goods.

 

You have to send back or hand over the goods at your own expense immediately, at the latest within fourteen days from the day on which you informed us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

 

You only have to pay for any loss in value of the item if this loss in value is due to handling you that is not necessary to check the condition, properties and functionality of the item.

§ 9 Transport Damage

 

 

§ 9.1 If items are delivered with obvious damage, please report such errors to the deliverer immediately and contact us as soon as possible on +34 641 75 74 42.

 

§ 9.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurance.

 

 

§ 10 warranty

 

 

The guarantee is based on the statutory provisions.

 

§ 11 liability

 

 

§ 11.1 We exclude liability for slightly negligent breaches of duty, insofar as these are not essential contractual obligations. In the event of a simply negligent breach of contractual obligations, our liability is limited to the typical, foreseeable damage. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract, endangers the purpose of the contract and on whose compliance the buyer regularly relies (cardinal obligations).

 

Section 11.2 Section 11.1 does not apply to culpable injury to life, limb or health, for guarantees or for mandatory legal claims (e.g. under the Product Liability Act).

 

§ 11.3 §11. also applies to breaches of duty by our vicarious agents.

 

 

§ 12 final provisions

 

 

§ 12.1 Should a provision of these terms and conditions be ineffective, the rest of the contract remains valid. In place of the ineffective provision, the relevant statutory provisions apply.

 

 

§ 12.2 Spanish law applies.
